1. Who we are

PortugalRealEstateLawyer.com is operated by Miguel Baptista, sole trader (Empresário em Nome Individual), Portugal. NIF: PT515384135. Contact: miguel@fractio.se.

For the purposes of GDPR, Miguel Baptista is the data controller for personal data submitted through this website.

2. What information we collect

We collect personal data when you voluntarily submit it via our consultation request form or any other form on this website. The information collected typically includes:

  • Full name
  • Email address
  • Telephone or WhatsApp number (optional)
  • Country of residence
  • Region in Portugal where you intend to buy
  • Estimated property value range
  • Stage of the purchase process
  • Free-text message describing your situation
  • Consent indication for being contacted

We also automatically collect limited technical information when you visit the website — IP address, browser type, device type, referring URL, pages visited, and date/time of visit. This data is used for site analytics and security purposes only.

3. Legal basis for processing

We process your personal data on one or more of the following legal bases:

  • Consent (Art. 6(1)(a) GDPR) — for the contact and follow-up of your consultation enquiry, and for sharing your data with a partner lawyer admitted to the Portuguese Bar.
  • Legitimate interest (Art. 6(1)(f) GDPR) — for site analytics, security, fraud prevention, and the operation of the website.
  • Legal obligation (Art. 6(1)(c) GDPR) — for retention required by Portuguese law.

4. How we use your information

We use the information you submit to:

  • Respond to your enquiry.
  • Assess the legal scope appropriate to your situation.
  • Where you have consented, connect you with a partner lawyer admitted to the Portuguese Bar (Ordem dos Advogados) — at which point the partner lawyer becomes a separate data controller for the purposes of providing legal services.
  • Send you the legal checklist or other lead-magnet content you have requested.
  • Maintain records of enquiries for site improvement and analytics.

5. Who we share your data with

We share your personal data only:

  • With a partner lawyer admitted to the Portuguese Bar, when you have given explicit consent for that disclosure via the consultation form.
  • With third-party service providers (web hosting, form processing, email delivery, analytics) acting as data processors on our behalf. These providers are bound by contract to process personal data only on our instructions.
  • With public authorities where required by Portuguese or EU law.

We do not sell personal data. We do not share personal data with marketing networks.

6. International transfers

Some of our processors (e.g. hosting and analytics providers) may be located outside the European Economic Area. Where this is the case, the transfer is made under appropriate safeguards — typically the European Commission Standard Contractual Clauses or an adequacy decision.

7. How long we keep your data

We keep your consultation enquiry data for as long as necessary to respond to the enquiry and for a reasonable period thereafter (typically 24 months) to maintain context for any future contact. After this period, the data is deleted or anonymised. Analytical data is retained on an aggregated basis only.

8. Your rights under GDPR

You have the right to:

  • Access the personal data we hold about you.
  • Correct inaccurate personal data.
  • Request deletion of your personal data ("right to be forgotten").
  • Restrict or object to processing.
  • Data portability — receive a copy of your data in a structured format.
  • Withdraw consent at any time, where processing is based on consent.
  • Lodge a complaint with the Portuguese data protection authority — Comissão Nacional de Proteção de Dados (CNPD) — at www.cnpd.pt.

We take reasonable technical and organisational measures to protect personal data against unauthorised access, alteration, disclosure, or destruction. No internet transmission is fully secure; we cannot guarantee absolute security.

We may update this privacy policy from time to time. Material changes will be notified via a notice on this page. The "last updated" date at the top of this page shows the date of the most recent change.
